I wish to participate in the event benefiting The Hospital for Sick Children Foundation, as well as various pre- and post-event activities (the "Event") and agree to abide by all rules, regulations, and instructions of the Event, as well as all applicable municipal, provincial and federal laws and regulations.

I understand that my participation in the Event and the use of services made available to participants during the Event is a potentially hazardous activity and can result in serious personal injury or death and property loss or damage or risk of exposure to infectious diseases such as COVID-19. I am aware of and expressly assume all risks (known and unknown) associated with participating in this Event, and I assert that my participation in this Event is voluntary.

I warrant that I (i) have sufficient health and physical fitness to enable participation in the Event, including any ancillary activities associated with the Event; and (ii) if, at anytime, I believe that any conditions or equipment used during the Event are unsafe, or that I am incapable of continuing, or if I am requested by any representative of the Released Parties (named below) or by any medical personnel to discontinue participation, I will immediately discontinue further participation in the Event or activity.

In consideration for being permitted to participate in this Event, I, on behalf of myself and my personal representatives, assigns, heirs and next-of-kin, hereby waive, release and forever discharge, from any and all claims for injuries, damages and losses to person or property that I may have arising out of the Event or my participation in the Event against The Hospital for Sick Children Foundation, The Hospital For Sick Children, any beneficiaries, sponsors, advertisers, celebrities participating in the Event, consultants, third-party vendors, owners or lessors of the premises where the Event takes place, government or public entities, and each of their respective affiliates, successors, officers, directors, members, employees, volunteers, agents, and representatives, (collectively referred to as the "Releasees"), of and from any and all proceedings, claims, demands, damages, costs, expenses, actions and causes of action (whether known or unknown) whatsoever, both in law and in equity, which I now have or may hereafter have for or by reason of or in respect of my participation in the Event whether as a spectator, participant, competitor or otherwise, and notwithstanding that same may have been contributed to, or occasioned by, the negligence of any of the Releasees.

I further hereby agree to indemnify all of the Releasees from and against any and all liability incurred by any or all of them as a result of, or in any way connected with, my participation in the Event, including, without limitation, transportation related to the Event. This means that I will reimburse the Released Parties if anyone makes a claim against them based on injuries, damages or losses sustained by me or others in connection with my participation in the Event.

I hereby waive any and all rights of recovery against the Releasees for injuries, damages or losses that are covered by an insurance policy under which I am insured. I understand that it is my responsibility to give my insurer (if applicable) notice of this waiver of subrogation.

I understand that the Released Parties do not provide any insurance, either life, medical or liability, for any illness, accident, injury, loss, or damage that may arise in connection with my participation in and attendance at the Event. If I want insurance of any kind, I must obtain my own. I will pay my own medical emergency expenses and all subsequent medical expenses in the event of any illness, accident, or injury in connection with the Event.

I agree that my participation in the Event is subject to the sole discretion of the organizers of the Event, and that my participation may be limited or terminated, with or without cause.

I give permission to The Hospital for Sick Children Foundation and The Hospital For Sick Children and each of their respective affiliates, subsidiaries, agents, consultants and representatives for the free use of my name, photograph, voice, likeness or statements, in any broadcast, website, telecast, advertising promotion, on social media or other use or reuse on account of this Event or marketing or promotion for future or similar events. I understand that once my image is posted on a website or other social media account, the image could possibly be downloaded by a third party. I agree that I will not hold The Hospital for Sick Children Foundation and The Hospital for Sick Children responsible for any harm that may arise from such unauthorized reproduction. I understand and consent that I will periodically be receiving communications related to my participation in the Event.

The provisions of this Waiver, Release and Indemnity shall enure to the benefit of the respective heirs, executors, administrators, personal representatives, successors and assigns of each of the Releasees and shall be binding upon my heirs, executors, administrators and personal representatives.

This Waiver, Release and Indemnity shall be interpreted and the rights of the parties determined, under the laws of the Province of Ontario and Ontario courts shall have exclusive jurisdiction for any dispute.

By clicking the button below, I acknowledge that I have carefully read this Waiver, Release and Indemnity and fully understand and agree to its contents. I understand and acknowledge that I am giving up substantial rights by accepting the terms of this Wavier, Release and Indemnity. I agree and acknowledge that I am signing this Waiver, Release and Indemnity freely and voluntarily, and intend by my agreement to be a complete and unconditional release of all liability against the Releasees to the greatest extent allowed by law. If any portion of this Wavier, Release and Indemnity is held to be invalid, the balance notwithstanding, shall continue in full force and effect.
